1. Agreement
By accessing FISCHRAINE or purchasing a FISCHRAINE Studio product, you agree to these Terms and our Privacy Policy. If you purchase on behalf of an organization, you represent that you have authority to bind that organization. You must be at least 18 years old, or the age of legal majority where you live, to purchase.
2. Handbook and Collector Build purchases
Both offerings are one-time purchases. Neither is a subscription and neither automatically renews. The price and included deliverables shown at checkout at the time of purchase control.
The Handbook offering includes permanent digital Handbook access and the self-guided implementation resources shown at checkout. Collector Build includes the Handbook plus 30 days of guided online support beginning when access is activated and one 30-minute 1:1 online session.
Payment is processed by a third-party payment processor. FISCHRAINE does not directly store your full payment-card number. Taxes, if legally required, may be added or collected through the payment process.
3. Personal license & intellectual property
FISCHRAINE and its original materials, branding, written Handbook content, workflows, layouts, documentation, prompts, templates and other original content are protected by applicable intellectual-property laws. Your purchase grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the purchased materials for your own lawful collection project.
You may not resell, sublicense, publish, upload for public distribution, share account access, reproduce substantial portions for others, remove ownership notices, or use the Handbook or related materials to create or sell a competing handbook, course, template library or substantially similar instructional product. Your own website, collection data, photographs and original content remain yours.
4. Support & 1:1 session
The 30-day support period begins when your Collector Build access is activated. Support is guidance, not unlimited development work or a promise that FISCHRAINE will build, operate or maintain your website for you. Reasonable response times may vary.
The included 1:1 session must be scheduled during the support period unless FISCHRAINE agrees otherwise. Please provide reasonable notice to reschedule. Missed sessions or repeated late cancellations may be treated as used, except where prohibited by law or where FISCHRAINE agrees to reschedule.
5. Accounts & acceptable use
You are responsible for maintaining the confidentiality of private access links and credentials and for activity under your account. Do not use the service to violate law, infringe intellectual property, interfere with systems, introduce malicious code, attempt unauthorized access, scrape protected areas, or abuse support channels. FISCHRAINE may suspend access reasonably necessary to protect the service, users or legal rights.
6. Third-party services
The Handbook may discuss or rely on third-party products and services such as domain registrars, hosting providers, databases, payment processors, email providers, AI tools, APIs and marketplaces. Those services are independent of FISCHRAINE and are governed by their own terms, pricing, availability and policies. Third parties may change or discontinue features without notice. FISCHRAINE is not responsible for third-party outages, account decisions, pricing changes, data loss or service changes.
7. No guarantees; informational nature
The Handbook and support are educational and informational. They are not legal, tax, accounting, investment or financial advice. Trading-card values and market information are estimates and may be incomplete, delayed or inaccurate. A displayed value is not a guaranteed sale price, appraisal or promise of liquidity.
Technology, APIs, AI tools and market conditions change. FISCHRAINE does not guarantee that you will reproduce the FISCHRAINE website exactly, achieve a particular design, launch date, revenue, audience, valuation, investment return or business result.
To the fullest extent permitted by law, the service and materials are provided “as is” and “as available.” Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
8. Refunds
Because Collector Build includes immediate access to digital materials, purchases are generally final once access has been delivered. However, FISCHRAINE will review duplicate charges, inability by FISCHRAINE to provide the purchased access, and other circumstances where a refund or remedy is required by applicable law. See the Refund Policy for details.
9. Limitation of liability
To the maximum extent permitted by applicable law, FISCHRAINE will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, lost opportunities or loss in card value arising from the service or third-party services.
To the maximum extent permitted by law, FISCHRAINE's aggregate liability arising from a Handbook or Collector Build purchase will not exceed the amount you actually paid FISCHRAINE for that purchase. These limitations do not apply where applicable law does not permit them, including liability that cannot legally be limited or excluded.
10. Your responsibility
To the extent permitted by law, you agree to be responsible for claims, losses or costs arising from your unlawful use of the service, your content, or your violation of another person's rights. This provision does not require a consumer to waive rights that cannot lawfully be waived.
11. Changes
FISCHRAINE may update these Terms prospectively as the offering or law changes. The effective date and version will be displayed on this page. Material changes will not retroactively remove rights already earned under a completed purchase where prohibited by law.
12. Governing law & disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Subject to any non-waivable consumer rights, disputes relating to these Terms or Collector Build may be brought in the state or federal courts located in Orange County, California, and the parties consent to those courts' jurisdiction.
Nothing here prevents a consumer from using a forum or remedy that applicable law requires to remain available.
